Real Estate Commissions - Who Really Pays Them Since the Realtor’s commission is built into the price of the home, it’s the buyer who ultimately pays it. This is contrary to what the real estate industry wants the public to believe - they say it's the seller who pays the Realtor fees. But in reality, if buyers and sellers dealt directly with each other – without the assistance of Realtors – the price of the home would be lower because there wouldn't be Realtor commissions factored into the price. So if buyers want the commission refunded, they must use a refund Realtor. How the refund process works You'll be locating homes on the Internet utilizing the thousands of home search websites. Or you can contact us for a more customized search. You'll be doing drive-by inspections yourself to approve of the homes' exteriors as well as the communities and specific neighborhoods. Once you find a home (or homes) you'd like to view from the inside, contact your agent for an appointment. When you find a home you want to purchase, We'll provide a list of comparable sales in the area so you can decide what price to offer the seller. We'll prepare the purchase contract and any addendums for your approval. We'll negotiate the offer to your advantage utilizing our years of experience in the real estate business. We would not suggest merely selecting an agent based on the best rebate, but rather a combination of the service to be provided as well as a buyer’s rebate. A good buyer’ s agent will go to bat for the home buyer that potentially saves the home buyer thousands extra through strong negotiations in all aspects of the transaction; one can be “penny wise, pound foolish” when selecting an agent solely on the amount of the rebate. What’s most invaluable is when a buyer’s agent will contend on your behalf for the numerous issues that usually arise during a real estate transaction. For-shadowing what other agents and real estate companies may say about buyer rebates and that they don't offer them: We can understand not wanting to lower my income. But that’s capitalism. If an agent or company can operate well without rebates, then they should do so and refuse to offer any such rebates. But if someone else is willing to negotiate their fee, what’s wrong with that? We feel that like for any service provided, both the price and the features should be negotiable. Imagine every car costing $40,000 no matter what, every computer costing $2,000, every haircut costing $50. Yes, a discount agent might offer discount service. But a full-price agent can also offer poor service. In the end, each home buyer should be able to make their own value judgments. |

The commission is built into the home's price and builders don't give discounts when buyers deal directly with them. So if you want the refund, we must accompany you to the builder's model home complex on your first visit - no exceptions! The builders are very strict about the first visit registration requirement. If you deal directly with the builder, you lose out on the refund and enrich the builder by the amount of the commission. |

| The Tishler Buyer Loyalty Rebate Program Summary IMPORTANT: New Jersey Real Estate Commission rules REQUIRE there be a written agreement with the buyer at the onset of the relationship. Otherwise no rebate may be issued. So you must sign up for this initially or it will not apply. The rebate will be paid as a “credit” to the buyer at closing or a check from the closing agent, thereby reducing our portion of the Broker commission. The Buyer must have purchased the home utilizing a Tishler associate. It does not have to be listed with Tishler, and can be listed with any real estate company, new construction, & for sale by owner. This is because Tishler is paying the rebate! The Buyer will be obligated to pay any applicable taxes for the receipt of the rebate and should contact a tax professional concerning the tax implications of receiving the rebate. All parties to the transaction, including the mortgage lender, must be notified of the rebate. The rebate is not contingent on the Buyer using any services or products. The Rebate amount is based only on commissions actually collected by Tishler Realty Group LLC. The calculation is based on the “Buyers side” portion of the commission, not on the “listing side”, if our office also happens to be the Listing Broker. This page does not create an agreement between the parties, that can only be accomplished through a written signed agreement. This is for NJ Buyer Rebates on Real Estate Commissions. The "ACT" permitting this practice was signed into law on January 17th 2010 including Rebates on Real Estate Commissions. As the Act is new, changes to our plan may need to be implemented to conform as requirements are clarified. Any aspect of our Buyers Rebate program which does not meet applicable rules, will be changed or modified.
